Yes, this is by design, Timers in scope of Sampler are run before sampler. In your case, the Constant Timer is not in scope of any Sampler so it does not lead to any pause.
Put it as child of Test Action with Sleep set to 0 is the best option, this way the pause will be executed at the exact place where the Test Action is located.
