XmlAnyElement not unmarshalled to JAXBElement in 2.0.6

I have this JAXBObject
    ....
    @XmlAnyElement(lax = true)
    protected List<Object> any;

In cxf 2.0.4 the Object is of type "javax.xml.bind.JAXBElement".
In cxf 2.0.6 the Object is of type
"com.sun.org.apache.xerces.internal.dom.ElementNSImpl".

Why is there a different behaviour after the Object is unmarshalled?
How do I get the 2.0.4 behaviour in 2.0.6?
