Xpath query and jcr:depth

Hi,
I would like to query my nodes using jcr:depth with something like :
/jcr:root/baseNodeName//element(*, my:type)[EMAIL PROTECTED]:depth=5] but it doesn't 
work.
Is it possible to use jcr: property as request conditions ?
