Er, I'm pretty sure GeoServer is wrong, we just this week got around to updating to the latest geojson spec, I think it's in svn, but not released yet. OpenLayers has definitely been ahead of us on spec implementation.

Looking at the last GeoJSON spec Geoserver seems to be in the right.
