They are arguably a threat to software innovation and can arguably hurt many more people than they help. It is important to understand their threat and to become active in the political process when possible. In my view, free/open source software is the future and the software patent issue will be a footnote in history. Regardless, the benefits of OpenOffice.org are available today, so I would use OpenOffice.org.
