If you arn't using styles you should be. F11 select page style, select "first
page" double click inside the first page. Go to the top of the page "insert
Break" manual break. If this doesn't resolve it turn on "view/non-printing
characters" and find out what charactor is messing you up.. and delete it..

The problem is likely that the TOC sets the start anchor at the start of
the document.
He can not insert a new line because the TOC was likely created with the
check next to "do not let the content be changed", which is almost
always what you want anyway.
He can not insert anything before this because the method used to insert
text content BEFORE other text content does not work for an "index" type.

Note that I consider this a bug since it DOES support the correct text
content interface according to the API spec shown above.
