I run the same type of cronjob on my home system every six hours and have 
never experienced that error.

Jan 30 16:30:02 cpollock spamd[2666]: server killed by SIGTERM, shutting down 
Jan 30 16:30:06 cpollock spamassassin: spamd shutdown succeeded
Jan 30 16:30:08 cpollock spamd[26223]: spamd starting 
Jan 30 16:30:08 cpollock spamassassin: spamd startup succeeded

According to my log it takes a total of 6 seconds from when spamd is killed 
until its restarted.  You may want to check to see if you have about the same 
time frame otherwise it could be a problem I'd guess.
