Subject: [ukma] Metric Martyr case: March 2nd, 2001

Council QC Eleanor Sharpston compared Mr Shrimpton to Lord Nelson, putting a blind eye to his telescope at the battle of Copenhagen.

"Mr Shrimpton's argument is based on turning a Nelsonian blind eye to the legislative, jurisprudential and constitutional landscape that has taken place but does not fit in with the defence case", she said.

"The fact that such a comprehensive blind eye is required should alert the court to the erroneousness of the chain of argument that has been put before it."

In summing up, she urged District Judge Bruce Morgan to ignore the publicity that surrounds the trial and concentrate on the crux of the matter.

"If we focus on this actual prosecution, and not the wider issues such as membership of the European Union, this prosecution is on the basis of two information's relating to the Weights and Measures act 1985", she said.

"There have been full admission of the facts.  We have moved so far away in this case from the actual prosecution that it might help to go back to the original regulations."

The court was due to take a short break following Miss Sharpstons summing up, before Mr Shrimpton outlined the defence case.

He was expected to finish by early afternoon, but Mr Thoburn will have to wait until April to learn the outcome, when Mr Morgan is to deliver his verdict.

Regards,

Steve.
