You are not being criminalized. You can use it as long as you like.  Just
like "20,000 Leagues Under the Sea" is still a great novel and "the whole 9
yards" a funny expression, even though no one has a clue what a "league" is
or what the orignal "9 yards" was all about.

What you can't do is use it in commerce and industry, which has nothing to
do with art. Here efficiency is important and common standards are
necessary.  It has nothing to do with detracting from your freedom, it's
just common sense.
