The principle of the 'single market' is one right at the heart of the European Community. If the UK forbid the movement of beer from other member states purely on the basis of the container size then that would be illegal (Cassis de Dijon). However, UK law does not discriminate against other member states because draught beer does not cross a border. You might perhaps construct a case based on the fact that a manufacturer in Austria would (in effect) not be permitted to sell litre steins in the UK. Incidentally, a litre stein could be filled legally with 852 ml of draught beer.
