It depends on the state in question.  The only state
where I even recall this type of law (that you can 
drive at any speed that is "safe" but that 
the posted limit is optimal) was either Montana or
one of the Dakotas.

Otherwise, the states that I've driven in use
the posted limit as a maximum speed.

Many highways also have a minimum posted speed.
