Thanks for the clarification Brendan! You are right I completely missed the
fact that FunctionDeclaration
can appear only as a SourceElement not as a Statement.
I've taken a quick glance on V8 sources and discovered that it allows
FunctionDeclaration as a Statement

Judging by the comment inside ParseFunctionDeclaration it was a deliberate
decision
