Only if the "v" result of step 1 is a strict function. The magic foo.caller behavior isn't specified, so if v would have been a strict function by virtue of that behavior, you can, without further violation of the spec, change that unspecified magic behavior to return undefined in that case if you wish, in which case the test in step 2 fails. Or not -- your choice.
