As a counter-example, Skype was trying to get the GPL invalidated in a
German court all the while running their operations on it, which is
legal (I asked the FSF about it at the time - note, expect 2 month
latency for such responses).

Curiously, if Skype had won they would have been hip-deep in copyright
violation.  It's important to remember the GPL is what makes the copying
legal - without the GPL copying the source code is illegal because it's
copyrighted, so copying can only be done legally by accepting the license.
