I'm still digging through it myself.  I did find the mention of it
protecting the inhabitants of the Antarctic...which usually covers body
parts.  Someone made that mistake here when they tried to say a dead whale
wasn't protected and took a chunk to catch a shark.  He was lucky in that
the law was new so they gave him a break and clarified it for him.  They
also had definitive information that the whale was already dead when he took
the meat.  Now the shark he caught is also protected so he won't be making
that mistake again.  Just a thought... why don't you email the board for
that website and ask them?  I'm sure they can give you a very reliable
answer.
I'm pretty positive based on all the information I was able to obtain from
reliable sources (the Boston Aquarium) and books that they are protected but
finding the exact part of this treaty that covers them I just don't have
enough time in the day for.  The treaty is also mentioned in the Eyes on
Nature book about Penguins that my kids have.  The curious part is I don't
think all penguins are found in the Antarctic???  But the book says ALL
penguins are protected and I have never seen penguin feathers with any of
the more "shady" dealers I know.  They would be the first to have them.
Penguins aren't rare birds but even Ken Sawada isn't tying with them that
I've seen and that guy has everything on his flies.
Ya just can't say we didn't warn you.  Remember also that they don't allow
you to play with sharp objects in jail so you might get a little rusty at
your fly tying.  :)   But we'll still visit you.
