Given that the original auther released it under the GPL, it was
obviously his intent that people could fork it, so I'd say got for it!
If he every resurfaces with a continued interest in working on it, then
you could always re-merge if you chose to.

FYI there's also another (MPEG-4 only) streaming server project on
sourceforge:
