I say we should lock all the spammers in the brig without charge or access to counsel! That'll teach the ingrates!

You can legislate the issue to death and nothing will change. What we really need is enforcement of the laws we already on the books. By that I mean look at it this way, the Government is always warning us about "cyber-terrorists", right? Well, what do you think a spammer is? I just bet that if cyber-terrorism charges were levied against some spammers and they were convicted on those charges, we'd see a lot less spam floating around the 'net.
