Now, to the message; this is an "FYI." We were contacted to submit our videos to a new site, offering access to "24 million people (5.5 million homes)....We are in the process of developing a weekly television show, called "Quick Flix", and believe your videos would be of interest to our viewers. The show will consist of various types of user-generated videos and is scheduled to go into production in early July." Here is a portion of their TOS: For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting the User Submissions to FLIX55, you hereby grant FLIX55 a worldwide, non-exclusive, royalty-free, fully paid, perpetual, sub-licensable and transferable license to publicly display, publicly perform, distribute and reproduce the User Submissions in any manner and in any medium, including, without limitation, through physical copies such as still photos, videos and CDs, by television by any means, on or via the Internet, including, without limitation, the World Wide Web, and any other two-way transmission control protocol/internet protocol (TCP/IP) based distribution network or similar networks or technologies now known or hereafter to become known, including, but not limited to, delivery via such a network to personal computers, hand-held devices, and television set-top boxes through telephone or cable lines, or wirelessly through broadband, satellite, cellular or terrestrial broadcast networks and other similar networks or technologies whether now existing or hereafter developed. You obtain no rights in any form, media or technology incorporating the User Submissions. You also hereby grant each user of the FLIX55 website a non-exclusive license to access your User Submissions through the website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the website and under these Terms. As I replied to them, it looks like a traditional TV lawyer got hired for the job, and it really doesn't work for me as an independent media producer. They re-host media files and there is no mention of making viewership stats available. Though I have inquired about that and about their plans for future compensation. There is some reference to contests and prizes. There is link back to the original source's web site. I'll keep you posted if I learn anything more.
