James,

Section 110 (1 and 2) would not apply, which means that you cannot perform or
display copyrighted works in the classroom, or for distance or hybrid classes
in the same ways that nonprofit schools can. You might need public performance
rights (to show films), or approval from the copyright holder. Some of your
performances or displays (showing clips from a film, showing images, etc.)
might be covered by fair use, but claiming fair use in such cases would be much
more context specific and would incur more risk for your institution. I think
those are the major differences. Of course, the purpose of your school being
for profit also would detract somewhat from your ability to make fair use
justifications.

Subject: [Videolib] For-Profit College

Hello all,

I work for a for-profit college. Could someone summarize how our copyright
concerns will differ from nonprofit schools?

VIDEOLIB is intended to encourage the broad and lively discussion of issues
relating to the selection, evaluation, acquisition, bibliographic control,
preservation, and use of current and evolving video formats in libraries and
related institutions. It is hoped that the list will serve as an effective
working tool for video librarians, as well as a channel of communication
between libraries, educational institutions, and video producers and
distributors.
