This case is in no way resolved, yet. We are reacting to a report from a legal reporting source on the oral arguments to dismiss the UCLA/AIME suit.
While the article reports that the judge intends to dismiss the case, she has not yet issued a ruling. We do not know what the basis of such a ruling (if issued) is/will be. It could be sovereign immunity, it could be lack of standing on the part of AIME, it could be on merits of the case. Even with those, there is still, for the present, the opportunity to amend the suit, and to appeal the ruling. A ruling based on sovereign immunity or lack of standing will not bring clarity.... only leave the door open for the battle to be fought with other litigants, who do not have immunity or do have standing.
