I meant to post something on this. I think it is similar to problem where
the DMCA was in direct conflict with fair use in terms of using clips and
that got sorted by LOC which made it clear you could break encryption for
clips.

I think the only issue here would be that if you close caption a copy then
the original is pretty much locked away since
you can't have two copies from one ( if it is cheap enough you could buy a
2nd one). This may be standard policy anyway not my area. I always feel
guilty when asked for permission to CC a film I rep, the permission is
always given but we never have a script or translation available that can
be used so libraries have to start from scratch. I have always wondered if
there was some database on this so once a library does it another library
can at least borrow the script.
