If Send As SMS is turned on in Message settings, that should allow for sending to non-iPhone users.
That sounds more like a network error. Are you on Wi-Fi when this happens? If so, try rebooting the Wi-Fi router. If on cellular, then I would bet it is a network issue. I have never had a faled to send error. If you are sending audio or pictures, also make sure Send As MMS is on.
