Hi Jonathan and list, a seller can, in fact, disable Find my iPhone remotely if he has forgotten to do this before the device is passed along. Assuming you are dealing with an honest seller, simply direct him to sign in to www.iCloud.com/find with his Apple ID and password. He can then erase the device remotely, and remove it from his account thus turning off Activation Lock. See this article for more information: http://support.apple.com/kb/HT5661. But I do agree removing the device before passing it along is best.
