I'm not arguing with you about any of those points -- the EULA is clearly
ridiculous.  However, I think it's reckless to tell people they can just
ignore it unless:

- You are a lawyer.
- You are willing to go up against a multi-million-dollar legal team if
someone
  does this and gets called on it by the BSA.

The idea is it's a contract, and if you don't like the terms you don't have
to accept it by buying the software.  Software companies are currently going
through a lot of effort to pass UCITA to ensure these shrinkwrap or
click-through contracts are legally enforcable, and they're meeting
surprisingly little resistance from people like us because we just assume
we'll always be able to ignore them.
