The [1]final, published version of this article from the [2]BYU Journal of Public Law is now available. The article, which I co-authored with Paul Gallant and Joanne Eisen, argues that personal self-defense is recognized as a universal human right, and is the foundation of international law. The article critiques a report by University of Minnesota Law Professor Barbara Frey, written for the UN Human Rights Commission/Council, which contends that self-defense is not a right, but is instead, at most, an excuse similar to duress or insanity.
