From Footnote 5 in her opinion in [1]Vermont v. Brillon:
Notably, the Vermont Supreme Court made no ruling under the State�s
own prescription, but instead relied solely on the Federal
Constitution. Because it did so, our review authority was properly
invoked and exercised. See Oregon v. Hass, 420 U. S. 714, 719�720
