Today the U.S. Court of Appeals for the D.C. Circuit released its decision in [1]Saleh v. Titan Corp. concerned a suit by Iraqi nationals against two defense contractors that provided services at the Abu Gharib prison facility. A divided panel held that the plaintiffs' state-law claims were preempted and affirmed the dismissal of their claims under the Alien Tort Statute. Senior Judge Silberman wrote for the majority, joined by Judge Kavanaugh. Judge Garland wrote a lengthy dissent.
