In the case of electron-capture there is no positron created, and hence there
can't be an gammas from positron decay.

However where both electron capture and beta+ decay are possible, sometimes the
one and sometimes the other will occur. The beta+ (positron) decay will then
obviously result in production of a pair of gammas when the positron annihilates
an electron.
