I can use a setting in /etc/default/hwclock as bypass.
root@voyage:~# echo "HWCLOCKPARS=--directisa" >> /etc/default/hwclock


So two options: fix rtc_cmos or apply the bypass.
Opinions?
rtc is obsoleted and removed in 3.10. You should research on proper replacement.
