I thought the 'patched' yum wasn't necessary when using Daniel's kernel
and util-vserver rpms.
It was never _strictly_ necessary, just recommended. I haven't looked at
yum much, so I don't know if the issues with it have been resolved in
the recent versions or if the warning is still relevant. I guess I could
disable it for the version in FC5.
