The Jerusalem Magistrate's Court yesterday threw out part of the indictment against our Board member, Mordechai Vanunu, and gave the state a month to submit an amended version. But the most interesting part of the ruling by Judge Yoel Tsur was that �an order preventing someone from leaving Israel does not preclude travel to the West Bank or Gaza.� He thereby accepted the defense's argument that since no passport or visa is needed to enter the territories, the West Bank and Gaza cannot be considered "outside Israel."
The judge�s ruling is a move de jure to what already exists de facto, namely that there is one state between the Mediterranean Sea and the Jordan River, call it Israel or Palestine or Israel/Palestine. Over half the people living in this one state are not Jews and thus, in spite of the contentions of most Jews, most Christian fundamentalists, and the mainstream Western media, Israel is simply not a Jewish state. Rather it is a state where hegemony lies with the Jewish minority and where the non-Jewish majority has lesser rights or no rights at all.
Israel�s argument that Vanunu needs to be barred from the territories for security reasons is just as absurd as its argument that he needs to be barred from leaving Israel altogether. It is noteworthy that both of these restrictions were imposed under the auspices of John Bolton who was sent to Israel by our State Department prior to the release of Vanunu from prison, after he served his full 18-year sentence for whistleblowing that Israel possesses nuclear weapons.
