Get Info on the files and see whether or not they are showing as locked. If so, unlock them and try again.

If not, the best way is to launch Terminal (in /Applications/ Utilities). First, open the Trash window, then run Terminal. In the Terminal window, type "rm -R" (that's rm<space><hyphen>R, obeying case and without the quotes), then drag the file or folder you want to delete from the Trash window onto the Terminal window and press Return. The problem should go away.
