Copying DVD

I am sitting here with a legitimately bought box set of Star trek  
Enterprise Series 1 But Disk 5 is unreadable. I have had no response  
from Paramount- This same thing happened in another box set of  
Voyager a while ago.
I have a Dual layer burner And I was thinking that I could replace  
the disk by burning   a new one .
I could use mac the ripper but Toast comes up with error codes. And  
popcorn quits.
As illegal as it may be can I simply burn a copy from an original  
that works
