As long as the code remains publicly available, which of these 2
options is used doesn't particularly matter since it would only be a
matter of changing a reference in the WIAB code if you wanted to host
your own WEG.

As long as you fetch all the assets, then you can 'clone' a gadget. As
for whether you can 'legally' clone a gadget is a different matter.
(Often there is no explicit license attached to them at all)
The XML file will directly reference any external assets (e.g. extra
stylesheets, javascript libraries, or images used), and as long as you
update the references to these in the XML file, you can put the gadget
wherever you want without issue.
