It may have been technically illegal for Malcolm to work for pay the first time he came to Mayberry, but as we know, when you're dealing with people it's a whole lot better to go not so much by the book, but by the heart. Remember that he was not looking for work, he simply needed a way to pay for damages he had caused, and Andy came up with a solution (which didn't really work, as it turned out).
However, the third time he comes to town, he announces his intention to stay and "try his hand at being an American." This indicates that by that time, he had most likely completed whatever paperwork was necessary to work in the USA. Funny that we never saw him again after that though.
