I think your best bet is to take this up with an attorney. Laws vary state to state. What one person tells you here that even if their lawyer told them is so - may not be true where you're at. This is a hard lesson but one that hopefully you'll learn to never work w/o a contract again. I learned the hard way myself and lost a bundle. Collection agency never did collect but then didn't figure they would. You could try a collection agency - even if you don't get your money - you have the satisfaction that eventually it will hit their credit report and you didn't do anything dirty, underhanded or illegal to make it happen.
