Microsoft asks judge to dismiss antitrust suit
Microsoft Corp. asked a federal judge Monday to dismiss the
landmark
antitrust suit filed against it in May by the federal
government and 20 U.S.
states. In an 88-page filing in U.S. District Court in
Washington, D.C.,
Microsoft contended that its Internet Explorer browser is
properly integrated
with its market-dominating Windows operating systems based on
clearly laid
out legal standards. Bill Neukom, Microsoft senior vice
president for law and
corporate affairs, said he hoped Judge Thomas Penfield Jackson
would at
least dismiss some of the government claims against the company
to narrow
the grounds for a trial scheduled to begin Sept. 8. Microsoft
also asked
Jackson to reject the government's request for a preliminary
injunction to
force the software company to either unbundle Internet Explorer
from
Windows 98 or ship the operating system with Netscape's Web
browser
included. A Justice Department spokeswoman said there was
"nothing new"
in Microsoft's filings. (Reuters)
