The witness, Massachusetts Institute of Technology economist Richard L. Schmalensee, said two niche operating systems that Microsoft lawyers have frequently cited as evidence of competition do not, in fact, pose a "a major competitive constraint in the short run." <snip> Boies then tried to suggest that Schmalensee's current position contradicted statements he made in the fall, when he testified as an expert witness for Microsoft in a private antitrust lawsuit brought by Bristol Technologies Inc., a small Connecticut software firm. In that case, Schmalensee appeared to take a narrower view of what constitutes a market, arguing that since Bristol did not produce an operating system, it was not a competitor to Microsoft.
