this is what I get for speaking too fast.... I am now using the AMD..... what didn't work was the AjaxModalContainer...
when I reread your mail I realized my mistake in the conversation.... I respectfully request your forgiveness and indulgence for my inaptitude... putting the datepicker in an AjaxModalDialog is working fine.
