Title: PRIVACY: Marketing

I haven't had to deal with the marketing issues until now. Let me ask you all this:

1)It's my understanding that as a payor, we would be allowed to send information to our members about other plans we offer that would be beneficial for them. And we could do that without an authorization or opt-out. Is this right?

2) We have 2 subsidiaries. One is a HMO and therefore CE. The other is a third party administrator and therefore a BA of an indemnity carriers. The same staff and computer systems are used for both. In fact, many staff don't even realize that on paper there are 2 companies. Can we send info about indemnity products to our HMO members?
