I have
a question regarding the provision of emergency and crisis based mental health
services....our company provides psychiatric crisis response systems for three
large counties in Maryland.....we use mobile crisis teams staffed with our
clinical staff and two police officers ( not our employees)......also
provide info and referral through a hotline....
Questions are.......
1) The police are a business associate so we need a BA agreement,
but can we continue to document oral consent over the phone and then give
clients our NPP when we arrive on scene?
2) What info, if any, can be released to the police if no charges
are filed?
3) For individuals who call our hotline for information and
referral, is oral consent enough to refer them to another agency for assistance
and do we have to mail out a NPP even if we don't see them for a face to face
medical contact?
