I, along with you,have gone around and around on this topic.  I have never been given a definite answer and it appears to be one of personal choice.  We provide similiar services as you.  Ou legal counsel has instructed us to draft a simple language business associate agreement.  In addition providing them with the education that we have provided to our own staff about what our HIPAA policies and procedures will be.

I keep going around and around on this topic. We have a few contracts with outside agencies that provide us will supplemental nursing/home health aide services. We provide them with the pertinent info about a patient and they provide services to the patient under our control & supervision. The forms and documentation completed are those provided by our agency and are submitted to our agency within a week of services.
 
I can't come to a definite decision on whether we need to generate a HIPAA compliant BAC/BAA or not.
