David: I am not sure it is all that inappropriate, given that H in HCCO is HIPAA and HCCO is commited to helping all the people/groups (CEs and vendors) in the health care industry.
Cynthia raised some very important issues in the "Issue Mediation" thread and such threads as well as her style of discussing them, are very valuable in general. WEDi may not be able to help or do a good job (like in the testing and certification area which I beleive happened because many have tremendous very valuable HIPAA domain knowledge but not a whole lot of testing and SQA methodologies/standards experience/expertise and that is ok as it can be and will be fixed slowly but surely) in all situations and other groups can help and this help is for the overall goodness of the healthcare industry. Also as has been said many times, most people are members of both HCCO and WEDi/SNIP and more groups and I guess in the end these individuals are volunteering their time independent of which hat they are wearing when responding on the listserv, the HCCO hat or WEDi hat or any other hat (consultant working with CEs and or Vendors in the HIPAA space like myself). OCR is responsible for enforcing Privacy rules and CMS for TCS & S. Correct me if I am wrong. So SNIP can help Issue Mediation or HCCO can. (I am not speaking for HCCO when I say this, I am wearing my individual/consusltant hat ALL THE TIME when I write to this lest serv, so that I don't have to repeat the std disclaimer that these are MY OPINIONS). Rachel suggested for example that people shold be able to contribute via the list serv and not necessarily have to participate in the teleconference calls on every other Thursday (testing SWG) and we discussed this and John sent the email to the list soliciting assistance and the list of things the group wanted help with and I am sure people, as individuals, still belonging to multiple groups, HCCO, WEDi SNIP or wearing their individual consultant / employee / employer hats are going to and some already expressed their areas of interest in which they will offer assistance. We can and should create mechanisms that will help CEs in their HIPAA compliance effort and HCCO, WEDi SNIP OCR, CMS, MAHI, AHIMA whoever can... should help. Of course in more legal issues and enforcement some agencies are drafted ;) to help via ligislations... This IMHO is good. Please don't worry about the bandwidth. The irrelevant issues will die soon due to their well... irrelevance ;) as will the relevant issues ;) ;) because people won't have the time or patience for long. I would definitely encourage one and all to take a more harsh stand against blatant advertisement though, like Marcallee recnetly wrote about the vendor when it comes to testing and certification, no matter who it is, and it has to STOP even if it is by a vendor who contributed a lot for the HIPAA effort. Call me crazy but I have faith we can do this together but not by saving bandwiidth ;). No offense. I would personally appreciate that these discussions cease on the WEDI listservs. Thank you. Following this email, HCCO comfirmed one of the value propositions for its members will be a mechanism for reporting and researching transactions issues, questions, concerns, and complaints. HCCO plans on providing education materials and mediation support to its members as well. This mechanism will be available on the HCCO website soon. Thanks for your interest! Julie A. I've asked several contacts about this, even some on this listserv. The best advice I've gotten was that once there is a mechanism in place for reporting complaints then I should follow the process for filing one. I do not believe there is such a "service" set up at this time. If anyone knows of one, if they could send out the info that would be great. I spent several weeks arguing with certain payers about their non-compliant request. But if I wanted to be approved for production in their system, I had to make the change. I don't consider this a "done deal," but at this time I don't know of any other recourse. Rich MacCatherine Software Engineer Source Medical, Inc. There major concern is lack of compliance (or none at all) from their trading partners. They do not want to cause a problem with their payors. What if there was an organization who they could report their concerns to, and this organization would act as a first level of education and/or mediation???"?
