Actually the record retention requirements in the
Privacy reg include all of the documentation required under that regulation and
not just disclosures. This would include authorizations, ack of receipt of NPP,
etc.

The only record

keeping the tracking of disclosures for 6 years.

Record Retention Requirement in TCS
I have not
seen any language in the regs/law re record retention for the electronic
transactions. Thus, your record retention policies for this should be based on
your company's and your state's requirements for such
records.

Transactions Workgroup List Cc: Anne Romer Subject: Record Retention Requirement
in TCS
Is there
any regulatory requirement regarding record retention in the TCS or Privacy
regs. Other than Best Practices, is there any requirement to retain
inbound or outbound files for a specific duration. My question
pertains to Claims, eligibility and remittance, as well as the other TCS
standard requirements.
