I agree with Paul.  The confusion within the industry is that the Final
Rule basically states that the owner of the code set determines the
rules for usage.  Within CPT, the Editorial panel advises that the user
should use the Anesthesia codes for anesthesia; however, it does not
currently say that they must use these codes.  I know that the CPT Panel
would like to eventually move in that direction, but not today.

I know many large payers who will still use the surgical codes and some
will use the anesthesia codes.
