I agree that a healthplan cannot opt to not implement a transaction - from the comments to the Transactions regulations (page 50314, middle column) comment 1 Electronically Transmitting Transactions...Response:...

With respect to health plans, a health plan is required to have the capacity to accept and/or send (either itself, or by hiring a health care clearinghouse to accept and/or send on its behalf) a standard transaction that it otherwise conducts but does not currently support electronically."

I do not believe that is correct - if you are a covered entity health plan
you are required to be able to receive and respond to a 278.   A health
plan cannot opt out of supporting any of the 9 transactions..

Only providers have the option of going to a paper based operation and not
having to comply with HIPAA transaction regulations.

My understanding is that a 278 response is only mandatory if you currently
have an electronic response for referral authorization.  However, if you
are like most plans and have a paper response process, I don't believe you
your required to implemented the 278 response.
