We can use LAME legally here.   :^)   I use LAME via WinAmp, primarily.

Sure you can.

Patent licensing would come into play only if you decided to start distributing 
an encoder and/or decoder "product" (either standalone or as part of another 
product).  And per <http://www.mpegla.com/avc/AVC_TermsSummary.pdf>, it's free 
if you distribute fewer than 100,000 units/year.
