That being said, you can get rid of the box and say something along the lines of "By clicking the "Upload" button below, you, [user], the copyright holder of this work..." to keep it as an affirmative act. However, that seems to take up more room than the check box. -By keeping "the copyright holder of this work" instead of "I took this photo", you allow people who have the rights to a work (but didn't take the photo themselves) to also contribute without having to do a white lie.
