According to the Silverpop privacy policy, they use tracking data gathered from "pixel tags" in dispatched emails for their own purposes, for example to "optimize delivery of future messages to specific recipients", rather than simply providing the gathered data to clients. <http://www.silverpop.com/About/Trust--Privacy/Privacy-Policy-Legal/Privacy-Policy/> That is not covered by the donor privacy policy, as far as I can see.
