I noticed the one year and was leary.

I suggest you call 1-800-3STAPLE and ask their customer service people what
is going on. They should be able to take your order on the phone and crank
the $40 "instant savings" in for you. Staples CSRs are usually pretty good
to deal with.
As to the drive itself, I have bought a lot of Maxtors over the years and
only had one fail, but since so many manufacturers have gone to the one year
warranty, I usually wait for a deal on Seagate now to get the 5 year
warranty.
